1. General

All offers and services provided by Cottbus Baumkuchen Manufaktur for the customer, as well as the use of the website www.baumkuchen-cottbus.de and all subdomains belonging to this domain, are exclusively based on the following general terms and conditions.

2. Conclusion of contract

The offers from Cottbus Baumkuchen Manufaktur on the Internet represent a non-obligatory invitation to the customer for ordering goods.

By ordering the desired goods, the customer makes a binding offer to conclude a purchase contract. A binding order with the customer can be transacted via the Internet, by e-mail, by post, by fax or by telephone, with full provision of the surname, first name, postal address and e-mail address.

Upon receipt of the order, the customer immediately receives an order confirmation by email, which indicates the expected price of the goods to be manufactured. The order confirmation does not yet constitute an agreement of the purchase contract.

The purchase contract enters into force by the sending of an invoice within five calendar days of the customer placing their order, through Cottbus Baumkuchen Manufaktur.

3. Prices, shipping costs

Orders of the customer are accepted at the respectively indicated prices and conditions. Prices are in Euro per 100g. The respective purchase price is then based on the actually balanced weight per item after the production of the goods.

All prices are inclusive of VAT plus shipping costs.

Shipping within Germany per delivery address:
– Per consignment we charge shipping costs of 6,00 EUR (up to 5kg), 8,00 EUR (up to 10kg) as well as 15,00 EUR (up to 31,5kg).
– Over 31.5kg only on request.
– From an order value of 50.00 EUR we ship free of charge within Germany.

Shipping within Europe (Zone 1):
– Per consignment we charge shipping costs of 13,00 EUR (up to 2kg), 15,00 EUR (up to 4kg), 17,00 EUR (up to 6kg), 19,00 EUR (up to 8kg) as well as 21,00 EUR (up to 10kg).
– Over 10kg only on request.
– Countries: Belgium, Denmark, France, Liechtenstein, Luxembourg, Monaco, Netherlands, Poland, Czech Republic, Austria

Shipping within Europe (Zone 2):
– Per consignment we charge shipping costs of 14,00 EUR (up to 2kg), 16,00 EUR (up to 4kg), 18,00 EUR (up to 6kg), 20,00 EUR (up to 8kg) as well as 22,00 EUR (up to 10kg).
– Over 10kg only on request.
– Countries: Bulgaria, Estonia, Finland, Greece, Great Britain, Ireland, Iceland, Italy, Croatia, Latvia, Lithuania, Malta, Portugal, Romania, San Marino, Sweden, Switzerland, Slovakia, Slovenia, Spain, Hungary, Vatican, Cyprus

Worldwide shipping (Zone 1):
– Per consignment we charge shipping costs of 28,00 EUR (up to 2kg), 34,00 EUR (up to 4kg) as well as 39,00 EUR (up to 6kg).
– Over 6kg only on request.
– Countries: Israel, Turkey, Russia

Worldwide shipping (Zone 2):
– Per consignment we charge shipping costs of 30,00 EUR (up to 2kg), 35,00 EUR (up to 4kg) as well as 40,00 EUR (up to 6kg).
– Over 6kg only on request.
– Countries: Japan, Canada, Singapore, USA

4. Payment options

We only accept bank transfer and PayPal as means of payment. For technical reasons, we are currently unable to offer credit card payments. Please note that costs incurred through international bank transfers are the sole responsibility of the buyer.

Upon receipt of the invoice, the customer commits to transfer the purchase price to Cottbus Baumkuchen Manufaktur within three working days.

After receipt of payment, the goods are immediately dispatched to the customer.

5. Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you, other than the carrier, take(s) possession of the goods.

In order to exercise your right of cancellation, you must inform us (Cottbus Baumkuchen Manufaktur, Carsten & Petra Hajek, Mühlenstraße 45, 03046 Cottbus, phone 0355 2 89 22 73, fax 0355 2 89 22 74, email baumkuchen@baumkuchen-cottbus.de) in a clear statement (e.g. a letter sent in the post, fax or email) of your decision to revoke this contract. You may use the attached example cancellation form, but it is not obligatory.

In order to comply with the cancellation period, it is enough for you to send us notice that you are exercising your right of cancellation before the cancellation period has expired.

If you cancel this agreement, we will return all the payments we have received from you, including the delivery costs (except for additional costs resulting from the fact that you have chosen a different type of delivery than the most favourable standard delivery offered by us) within fourteen days of the date on which the notice of cancellation of this contract was received by us. The repayment shall be made using the same payment method that you used for the original transaction, unless otherwise explicitly agreed with you; under no circumstances shall you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have proven that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately, in any event no later than fourteen days from the date on which you notified us that you were cancelling this contract. The deadline shall be deemed to have been observed if you send the items before the fourteen-day deadline has expired. You shall bear the direct costs of returning the goods. The costs have been estimated to be about 8.00 Euros at the most.

You must only pay for a possible loss of value of the goods if the loss in value is attributable to handling which is not necessary for examining the quality, characteristics or functioning of the goods.
